What personal data we process

TheReSales processes your personal data because you use our services and/or because you provide them to us yourself, for example via the contact form, quotation form, purchase form, telephone contact or when purchasing or selling in our shop.

When purchasing furniture: identification details that we must record in our purchase register under tax law (such as name, address, and a copy or number of a valid identification document)

Special and/or sensitive personal data that we process

Our website and service do not intend to collect data from visitors under the age of 16, unless they have consent from a parent or guardian. However, we cannot verify a visitor's age. We therefore recommend that parents be involved in their children's online activities to prevent data from being collected about children without parental consent. If you believe we have collected personal data about a minor without such consent, please contact us via info@theresales.nl, and we will delete this information.

When purchasing furniture from private individuals, we record details from an identification document. This is a legal requirement under the globalisation scheme (margin scheme) for second-hand goods. These details are used solely for this purpose and are not shared with third parties, unless we are legally obliged to do so (e.g., for inspection by the tax authorities).

For what purpose and on what legal basis do we process personal data?

TheReSales processes your personal data for the following purposes:

Processing your purchase, including the creation and sending of invoices (basis: performance of the agreement)
The processing of a purchase of your furniture, including legally required administration in the purchase register (basis: execution of the agreement and legal obligation)
Processing your payment (basis: performance of the contract)
Issuing quotes and answering questions via the contact form, quote form, email or telephone (basis: performance of the agreement or legitimate interest)
Dispatching goods and informing about delivery (basis: performance of the contract)
To be able to call or email you if this is necessary to perform our services (basis: execution of the agreement)
We will inform you about changes to our services and products (basis: legitimate interest)
Analysing your behaviour on the website to improve the website and product offering (basis: consent via cookie banner)
Showing ads via Google and Meta that align with your interests (basis: consent via cookie banner)
Complying with legal obligations, such as our administrative and tax duties (basis: legal obligation)

Automated decision-making

TheReSales does not make decisions based on automated processing that may have (significant) consequences for individuals. This refers to decisions made by computer programs or systems, without human intervention.

How long we store personal data

TheReSales does not store your personal data for longer than is strictly necessary to achieve the purposes for which your data are collected. We use the following retention periods:

Invoices, order and payment details 7 years, based on the fiscal retention obligation
Procurement administration (procurement register) with ID details: 7 years, based on the fiscal retention obligation under the globalisation scheme
Contact form, quote requests, and email correspondence: maximum of 2 years after last contact, unless this leads to an agreement (then the tax retention period applies)
Purchase order submissions without follow-up: Maximum 12 months
Personal data linked to warranty and service requests: for as long as necessary for the provision of guarantee and service

Sharing personal data with third parties

TheReSales does not sell your data to third parties and only provides it if it is necessary for the execution of our agreement with you or to comply with a legal obligation. With companies that process your data on our behalf, we enter into a processor agreement to ensure the same level of security and confidentiality of your data.

We use the following third-party categories, among others:

Website hosting Our website runs on WordPress/WooCommerce and is hosted by WordPressor
Payment service provider Buckaroo processes payments via iDEAL, debit card, credit card, PayPal, Apple Pay, Google Pay, Bancontact, Wero and other available methods
Delivery services: depending on the shipment, we work with PostNL, DHL, FedEx, DPD, Magic Movers and Libero, or we deliver ourselves
Till system our own developed checkout system for in-store processing
Marketing analytics Google Analytics, Google Ads en Meta (Facebook/Instagram) for measuring and optimising our website and advertisements, solely after you have given your permission via our cookie banner.
Accountant and tax advisor for the administration of our accounts and tax returns
Government and regulators as the Tax Authority, when we are legally obliged to do so

Transfer outside the European Economic Area (EEA)

Our customers are mainly located in the Netherlands and the EU. In exceptional cases, we supply customers outside the EEA. In that case, the data required for delivery (such as name, address and telephone number) will be shared with the relevant delivery service to process the shipment.

In addition, some of our processors (such as Google and Meta) may process data outside the EEA. In those cases, we ensure that the transfer takes place on the basis of appropriate safeguards, such as standard contractual clauses approved by the European Commission or an adequacy decision.

Cookies, or similar techniques, that we use

TheReSales uses cookies and similar technologies. A cookie is a small text file that is stored on your computer, tablet or smartphone when you first visit our website. We use the following types of cookies:

Functional cookies: necessary for the technical operation of the website and your ease of use. Think of remembering the contents of your wishlist or your preferred settings. These cookies are always placed.
Analytical cookies: Using Google Analytics, we measure how visitors use our website so that we can improve it.
Marketing and tracking cookies: Via Meta (Facebook Pixel) and Google Ads, we show personalised advertisements and measure the effectiveness of our campaigns.

Analytical and marketing cookies are only placed after you have given your consent via our cookie banner. You can withdraw or adjust your consent at any time via the cookie settings on our website.

You can also opt out of cookies by configuring your internet browser to not save any more cookies. You can also delete all previously saved information via your browser's settings.

Social media

TheReSales is active on various social media platforms, including Instagram, Facebook, Pinterest, TikTok and LinkedIn. When you contact us through these platforms, we may use your message and username to respond. Please note that the use of these platforms is subject to the privacy terms and conditions of the respective provider, over which we have no control.

Reviews

We collect customer reviews via Google. When you leave a review, your username and the content of your review will be visible to other internet users. Google's terms and conditions and privacy policy apply to the collection and posting of reviews via Google.

View, amend or delete data

You have the right to access, correct or delete your personal data. In addition, you have the right to withdraw any consent you have given for data processing or to object to TheReSales processing your personal data, and you have the right to data portability. This means that you can submit a request to us to send your personal data, which we hold, in a computer file to you or to an organisation named by you.

You can send a request for inspection, correction, deletion, data transfer, withdrawal of consent, or objection to processing to info@theresales.nl.

To make sure the request is made by you, we ask you to send a copy of your identity document with the request. In this copy, black out your passport photo, MRZ (machine readable zone, the strip of numbers at the bottom of the passport), passport number and Citizen Service Number (BSN). This is to protect your privacy. We will respond to your request as soon as possible, but within four weeks.

How we protect personal data

TheReSales takes the protection of your data seriously and takes appropriate technical and organisational measures to prevent abuse, loss, unauthorised access, unwanted disclosure and unauthorised modification. Our website uses an SSL certificate to send encrypted data. If you have the impression that your data is not properly secured or there are indications of misuse, please contact us via info@theresales.nl.
